This document describes what the software actually does, written from the source code. It has not been reviewed by a lawyer, and the highlighted {{PLACEHOLDER}} markers still need real values (legal entity, address, governing law, contact address, effective date).

Do not rely on it, and do not submit it to an app store, until both are resolved.

Terms of Service

The deal between you and us: what you can expect from Nishtu, and what we expect from you.

1. The agreement

These terms are a contract between you and {{LEGAL_ENTITY}}, of {{REGISTERED_ADDRESS}} (“we”, “us”), covering your use of the Nishtu website at {{DOMAIN}} and the Nishtu Android application. By creating an account you accept them. Our Privacy Policy explains how we handle your data and forms part of this agreement.

2. What Nishtu is

Nishtu stores your recipes, estimates their nutrition, tracks what is in your kitchen, and helps you plan and log what you eat. Some features — including photo, menu, receipt and voice capture, and AI-assisted recipe import — depend on third-party AI services and are available only while those services are.

Your recipes, photos, pantry, plans, logs and goals remain yours. We claim no ownership of them.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and process your content solely to operate the service for you — including sending an image, an audio clip or a piece of text to the AI providers named in the Privacy Policy when you use a feature that requires it. If you publish content to a group or publicly, that licence extends to displaying it to the people you published it to. The licence ends when you delete the content, except for material already shared with others as described in §5.

You confirm you have the right to upload what you upload. Recipe methods generally are not protected by copyright, but the words and photographs someone wrote and took usually are: do not paste another person’s recipe text or images and publish it as yours.

5. Sharing and public recipes

You choose the visibility of each recipe: private, shared with specific groups, or public. A public recipe is readable by anyone with the link, including people who are not signed in, and is attributed to your profile. Changing visibility later does not retract copies other people have already taken.

Public recipes can be reported by other users. We may review reported content and remove anything that breaches §6, at our discretion.

The scanning, import and voice features carry daily limits per account. These exist because each call costs us money; we may adjust them.

7. Nutrition estimates are not advice

Every nutrition figure in Nishtu is an estimate, and estimates are sometimes wrong. They are computed from food composition databases, from your own entries, and — for photo, barcode, menu, receipt and voice features — from an AI model’s reading of an image or a sentence. The app shows you which figures are estimated and which need review; please look.

Nishtu is not a medical device and provides no medical, dietetic or nutritional advice. Do not rely on it to manage a medical condition, a therapeutic diet, an allergy or an intolerance. Always check the actual packaging for allergens. Consult a qualified professional before making decisions about your health.

8. Pro subscriptions

Some features require a Pro subscription, available on a monthly or annual basis with a 7-day free trial you may opt into once. The price is shown to you before you pay and is charged in the currency displayed at checkout. Subscriptions renew automatically for the same period until cancelled.

If a renewal payment fails, we keep your access for a short grace period before Pro features are withdrawn. We may change prices; changes apply from your next renewal and we will give you notice before they do.

9. Cancelling and refunds

Cancel a web subscription from Settings → Billing, and a Play subscription through the Google Play subscriptions screen. Cancelling stops the next renewal; you keep Pro until the end of the period you have paid for. Purchases made through Google Play are refunded under Google’s refund policy, not ours. For web purchases, and for any statutory cancellation right you have under {{JURISDICTION}} consumer law, contact {{CONTACT_EMAIL}}.

10. Beta service and availability

Nishtu is currently offered as a beta. Features may change, break or be withdrawn, and data loss, while not intended, is more likely than in a mature product. Keep your own copy of anything you cannot bear to lose. We do not promise any particular uptime.

11. Suspension and termination

You may stop using Nishtu and delete your account at any time. We may suspend or terminate an account that breaches these terms, that we are legally required to act on, or that is being used to harm the service or other users — with notice where it is reasonable to give it. If we terminate your account other than for breach, we will refund the unused portion of any subscription you paid for directly.

12. Our intellectual property

The Nishtu software, name, branding and design are ours (or our licensors’) and are not transferred to you. You get a personal, revocable, non-transferable licence to use the app as intended. Nutritional reference data comes from third-party food composition sources under their own licence terms.

13. Disclaimers and liability

The service is provided “as is”. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, or lost or corrupted data beyond what we can restore from our own backups. Nothing here limits liability that cannot lawfully be limited — including for death or personal injury caused by negligence, for fraud, or for your non-excludable statutory rights as a consumer. {{LIABILITY_CAP}}

14. Changes to these terms

We may update these terms as the product changes. The effective date above always reflects the current version; we will notify you in the app before a material change takes effect, and continuing to use Nishtu afterwards means you accept it. If you do not, delete your account.

15. Governing law

These terms are governed by the law of {{JURISDICTION}}, and disputes are subject to the courts of {{JURISDICTION}} — without depriving you of the protection of mandatory consumer law in your country of residence.
